- Preamble
The present conditions are concluded between, on the one hand, the SPRL MF Dynamics, registered at the Crossroads Bank of Enterprises under the number BE 0809 103 427, avenue des 9 Provinces, 29 1083 Ganshoren, hereafter called "CLAK" and, on the other hand, the persons wishing to make a purchase via the CLAK website (clak.be), hereafter called "the customer".
- Fields of application
The present general conditions apply to all sales of products presented on the clak.be website. Any order placed with CLAK must lead to the validation of the general terms and conditions of sale and therefore leads to the unreserved acceptance of these terms and conditions.
3.1 Stocks
The state of stocks mentioned on the clak.be website is indicative and is updated in real time. However, it is possible that two customers order the last T-shirt in a series at the same time. Under these conditions, CLAK undertakes to propose a new delivery date depending on the supplier's own deadlines to one of the two customers if the T-shirt ordered has to be re-issued. If the T-shirt is not to be reissued, CLAK undertakes to refund the customer in the form of a voucher or to cancel the order and refund the customer as soon as possible.
3.2. Delivery and deadlines
Regarding delivery times, CLAK undertakes to hand over the order to a carrier within 10 working days from the day on which payment is validated by the financial organisation that manages credit card collections.
In the event of a loss on delivery, CLAK will only reimburse the customer after the carrier has officially declared the ordered products lost.
- Validation of the Contract
The sales contract shall only be deemed to have been concluded once the customer's account has been debited in the case of credit card payments. In the case of payment by bank transfer, the sales contract shall be deemed to have been concluded once the payment has been recorded in CLAK's bank account.
4.1. Commands
When you arrive on the clak.be website, the homepage will show you the products on sale.
To purchase a product, simply click on the product sheet of your choice.
To place an order, simply click on the "add to cart" button shown with a small basket next to the desired size.
Your order will be automatically added to your shopping cart; you can then continue shopping and do the same for other models.
Once the basket is filled, the customer can place an order by clicking on the panel above the basket. Placing an order implies that the customer provides their exact delivery and billing addresses, checks the exact amount that will be invoiced to them, including the price (including VAT) of each T-shirt as well as the price (including VAT) of the delivery charges, selects the delivery method as well as the payment method and clicks on "Complete my purchases".
Upon receipt of the order, the customer receives a package containing the T-shirt(s) ordered.
4.2. Secure payment
Online payment of products by credit card is made through Stripe. The data recorded by the payment system constitutes proof of the financial transactions carried out by bank card. Stripe does not transmit credit card payment information except, if necessary, in the event of a duly expressed complaint regarding a particular transaction.
The customer declares that he/she has all the necessary authorisations for payment by credit card when validating his/her order. In the event of suspicion of fraud, CLAK reserves the right to initiate an additional information procedure towards a customer by requesting various proofs and, following this procedure, to cancel or suspend any order or delivery, even in the event of payment authorisation issued by Stripe.
- Right of withdrawal for private individuals
Under the conditions provided for by law and in the context of distance selling, the buyer has a withdrawal period of 14 clear days from the delivery of his order, which will be reimbursed against the return of the products delivered.
The buyer must return the goods in their original condition to the following address Sterrenlaan 27 - 1700 Dilbeek - Belgium. He will be reimbursed for the amount of his purchases within 30 days.
The return of goods is at the expense and risk of the buyer.
- Data Protection Act
In accordance with the French Data Protection Act, the customer has the right to access and rectify data concerning him/her. CLAK guarantees the customer full respect for confidential information recorded on computer media.
CLAK undertakes not to divulge any information that could enable third parties to know confidential data within the meaning of the French Data Protection Act.
